These Terms of Service ("Terms") form a legally binding agreement between you and CliqFeed ("CliqFeed," "we," "us," or "our"). By accessing or using CliqFeed services through our website and app experiences (collectively, the "Service"), you agree to these Terms. If you do not agree, you must not use the Service.
1. Eligibility
- You must be at least 18 years old to use the Service.
- You must have legal authority to enter into a binding contract.
- If you use CliqFeed for a business, you confirm you are authorized to accept these Terms on that business's behalf.
- You may not use the Service where prohibited by applicable law.
2. Description of Service
CliqFeed helps creators and teams discover topics and generate platform-ready content formats such as captions, post drafts, carousels, and related assets.
Features may include AI-assisted generation, style controls, workspace preferences, and publishing integrations (for example, Instagram connectivity where available). We may modify, improve, suspend, or discontinue features at any time.
3. Accounts and Access
Some features require an account, connected authentication providers, or connected social platform permissions. You are responsible for keeping account credentials secure and for activity under your account.
You must provide accurate information and promptly update details that are no longer current. You agree not to share credentials or bypass access controls.
4. Subscriptions, Billing, and Plan Limits
CliqFeed may offer free and paid plans. Paid features, usage quotas, and limits depend on your active plan and are subject to change.
If a plan auto-renews, renewal charges occur at the billing interval you selected unless canceled before renewal. Payment processing may be handled by third-party providers.
Unless otherwise required by law or expressly stated, fees are non-refundable once a billing period begins.
5. AI-Generated Output and Editorial Responsibility
CliqFeed provides AI-assisted suggestions, drafts, and transforms. Generated output may be incomplete, inaccurate, outdated, or unsuitable for your audience without review.
You are solely responsible for verifying factual accuracy, intellectual property clearance, legal compliance, advertising disclosures, and platform policy compliance before publishing any output.
6. User Content and License
You retain ownership of prompts, uploads, brand assets, and other content you provide ("User Content"). You grant us a limited, non-exclusive, worldwide license to host, process, and use User Content solely to operate, secure, and improve the Service.
You represent that you have all rights needed for User Content you submit and that such content does not violate law or third-party rights.
7. Acceptable Use
You may not misuse the Service. Prohibited conduct includes:
- Violating applicable laws, regulations, or third-party rights.
- Generating or distributing unlawful, fraudulent, abusive, hateful, or deceptive content.
- Attempting unauthorized access, reverse engineering, scraping, or disrupting platform systems.
- Uploading malware, malicious scripts, or content designed to harm others.
- Using the Service to impersonate others or misrepresent affiliation.
8. Third-Party Services and Integrations
The Service may rely on third-party tools, APIs, and social platform integrations. Your use of connected third-party services is also governed by their terms and privacy practices.
We are not responsible for third-party service availability, policy changes, or actions taken by those providers.
9. Intellectual Property
The Service, including software, workflows, branding, and visual assets (excluding User Content), is owned by CliqFeed and protected by intellectual property laws.
Subject to these Terms, we grant you a limited, non-transferable, revocable license to access and use the Service for lawful business or personal use.
10. Service Availability and Changes
We may update or change the Service to improve performance, security, and feature quality. We do not guarantee uninterrupted or error-free operation and may perform maintenance, apply usage limits, or suspend features when required.
11. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLIQFEED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLIQFEED WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
WHERE LIABILITY CANNOT BE EXCLUDED, OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO CLIQFEED IN THE PRECEDING 12 MONTHS OR INR 1,000.
13. Indemnification
You agree to defend, indemnify, and hold harmless CliqFeed, its team, affiliates, and partners from claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Service, User Content, or breach of these Terms.
14. Suspension and Termination
You may stop using the Service at any time. We may suspend or terminate access where necessary for security, legal compliance, abuse prevention, non-payment, or Terms violations.
Sections that by nature should survive termination, including intellectual property, disclaimers, liability limits, and indemnification, remain in effect after termination.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of India, without regard to conflict of law principles.
Before filing a formal claim, you agree to attempt informal resolution by contacting contact@cliqfeed.com.
If unresolved, disputes will be subject to the competent courts in India having jurisdiction over CliqFeed's principal place of business.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we update the "Last updated" date on this page. Continued use of the Service after revised Terms become effective means you accept the changes.
